User Product Purchase Policy

By this instrument, the individual or legal entity qualified in the System Identification Registry, which is an integral part of this Agreement; and Monzzini LTDA., a private legal entity; have entered into this Agreement with each other, once their adhesion to the System has been approved, under the terms and conditions below:

The parties agree that, for the purposes of this agreement, the company's only authorized and recognized sales website is www.monzzini.com.br and all commercial transactions must be carried out exclusively through this website.

1 – Procedure

The user may purchase products from Monzzini after completing and filling out the registration regarding his/her own person on the payment processing Website with true, updated and accurate information, as well as complying with all provisions of the Terms of Use and carrying out transactions in his/her own name and never on behalf of third parties, and, finally, having the legal capacity to enter into agreements and transfer titles and interests of any product that may be purchased from Monzzini.

After registering on the payment processing platform website, the User will choose which product(s) will be purchased and the payment method used.
After choosing the product(s) and immediately transferring the value of the product to Monzzini's account, the order confirmation will be made.
No product will be sent to users before the order is confirmed, which will occur upon verification that the value of the product has in fact been credited to Monzzini's account.
Once the payment has been credited to Monzzini's account, Monzzini will send an email confirming the order based on the data provided by the user.
Confirmation of the order placed formalizes the existence of a contract between the two parties (Monzzini AND USER), in accordance with the Terms of Use.
No other contractual stipulations will be accepted by the user, with these terms of use serving as the only valid contract between the parties.
Monzzini has the right to terminate the contract (cancel the order) in the event of clearly identified errors or inaccuracies in relation to the products listed on the Website.
Monzzini undertakes to deliver the product(s) to the delivery address provided by the user. If the user provides incorrect or inaccurate data or information regarding their address, any costs arising from shipping the product to a location other than that registered on the Monzzini website will be the user's responsibility.
2 - Transportation

Monzzini only transports physical products and is not responsible for any problems such as theft, damage or loss of the product(s) purchased by the user during transport, as such responsibility is inherent to the carrier, and transport is not considered a risk inherent to business activity.

Shipment Tracking: Under this policy for purchasing products by users, Monzzini reserves the right to use shipping services offered by partner companies to deliver products purchased by customers. Therefore, the Company will endeavor to provide customers with the necessary information to track their products using the tracking code provided by the partner company responsible for shipping.
It's important to note that, due to the use of partner companies for shipping, delivery times and product tracking may vary, subject to availability and the policies of these partner companies. Monzzini is not responsible for transit times or product tracking, which are subject to the policies and procedures adopted by these partner companies.

Customs Fees: If products purchased by customers are subject to customs taxes, Monzzini undertakes to cover all expenses related to such fees. Customers are not responsible for paying any customs fees on the products purchased.

It's important to note that customs taxes can impact product delivery times, as customs clearance is an independent process and subject to customs inspection. Monzzini is not responsible for delivery delays resulting from customs taxes, as this situation is beyond its control.
Customer Cooperation: Customers are obligated to cooperate with Monzzini in resolving customs fees, providing any information and documents requested for product clearance with customs authorities. Failure to cooperate may delay the customs clearance process.

Tracking Code Delivery: Customers will be informed that their order's tracking code will be available within 72 (seventy-two) business hours after payment confirmation and order processing by Monzzini. Monzzini will endeavor to provide the tracking code as quickly as possible, but this timeframe may vary depending on availability and internal procedures.

3 - Payment

Payments will be made by credit card.

4 - Delivery Time and Regions Served

Monzzini delivers products to several countries. Delivery times vary depending on the destination:

• Australia: 4 to 10 business days

• Other countries: 8 to 14 business days

• It is important to note that all delivery times indicated above are approximate and are subject to variations and delays due to factors such as carrier policies, transportation logistics and customs inspection.
  
  5 - Returns and refunds
  
  Customers who make purchases on the Monzzini website have up to 7 (seven) days after receiving the product to cancel their purchase without any additional costs. In this case, the customer may request a refund of the purchase amount, less shipping. The refund will be made using the same method used to make the purchase, with the timeframe depending on the payment method chosen.
  
  Purchases made by credit card can be refunded in up to two subsequent statements.
  Returns must be requested within 7 days of receiving the product. Returns made if the product has been used, damaged, or is not in its original packaging, or if the packaging is damaged, may not be accepted, and your purchase will be returned to you. Returns will only be accepted if the product is free of signs of use, stains, and scratches, and meets the exchange or return conditions.
  The request must be made via the email address provided to Monzzini. Contacts via Instagram direct message or commercial WhatsApp, or any other means other than the email address provided by Monzzini, will not be considered valid.
  The product(s) must be in the original condition in which it was sent and unopened. The Company will refund the amount corresponding to the purchase price.
  In the event of a product being returned, the shipping costs will be borne by the Company.
  Monzzini informs that it has 07 (seven) business days to register the return of the returned product(s) and process the due refund.
  The refund will only be made after the product returns to Monzzini's headquarters and is subjected to a new evaluation, verification and refund will be made within 7 (seven) business days.
  If it is found that the returned product does not match the technical specifications and condition in which it left Monzzini, the latter is not obliged to issue any type/kind of refund.

  6 - Exchange
  
  The deadline to request an exchange is up to 7 calendar days after delivery of the order.
  
  To exchange a product you must return it, specifying the reason for the exchange.
  In case of exchange due to defect or sending of wrong product, no additional fees will be charged, Monzzini will bear all costs, for other reasons of exchange a fee will be charged, calculated according to the customer's address.
  If the user wishes to exchange the product for another model of a higher value, they may do so, provided they pay the remaining difference for the purchase and, if applicable, the additional fee.
  If the user wishes to exchange the product for a lower-priced model, they may do so as long as the purchase price is deducted. Any excess amount will be refunded to the user.
  The deadline for sending the exchanged product is 30 (thirty) business days from the evaluation made upon return of the product to Monzzini headquarters. The delivery time will comply with the provisions of item 4.1.
  Model exchanges will not be made unless made within 12 hours before the order is shipped.
  Once the purchase is complete, products cannot be added to the same order.
  7 - Cancellation and change of address
  
  The customer has the right to cancel an order or request a change in the delivery address before the order is shipped by Monzzini. To exercise this right, the customer must contact Monzzini's customer service team through the communication channels provided.
  
  The order can be canceled or the delivery address can be changed at no additional cost as long as the customer makes the request within a period of up to 12 hours from the time the order was placed.
  8 – Final Considerations
  
  This term applies to all deliveries of goods made by Monzzini. The delivery times and conditions set forth herein are intended to provide an estimate to customers, and the Company cannot guarantee exact delivery times due to the variations involved in the international transportation process.
  
  Monzzini reserves the right to change or modify this term in accordance with the shipping policies and conditions of the partner carrier, with due notification to customers.
